NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT IMPROVE CHANCES OF WINNING.
ELIGIBILITY: Open only to legal residents of the United States (excluding Puerto Rico), age 21 or older ("Eligible Participants"). Void in Puerto Rico and where prohibited. All federal, state and local laws and regulations apply. Employees, officers, directors and agents of Starz Entertainment, LLC. and their respective parents, subsidiaries , service providers, suppliers, advertising and promotion agencies and any others associated with this Sweepstakes (and members of their immediate families) are not eligible to participate. Sweepstakes begins on or about 12:00:01 AM PT June 26, 2009 and ends 11:59:59 PM PT August 23, 2009 (Sweepstakes Period).
TO ENTER: There are two ways to enter:
To enter the Sweepstakes, Eligible Participants can log onto www.starz.com/bighdsweeps. (Web site), click on the icon, banner or text link to access the Sweepstakes registration page, and follow the directions to enter. All Internet entries must be received and recorded by Sponsor's computer (the official Sweepstakes time keeping device) by 11:59:59 PM PT on August 23, 2009. When online, you will need to enter your full name, address, city, state, zip code, daytime phone number and e-mail address. For details on how your information may be used, see Sponsor's terms of use/privacy policy at www.starz.com.
By Mail: Alternately, to enter by mail, print your name, complete address, zip code, daytime phone number with area code and e-mail address (if available) on a 3" x 5" card. Mail in a first class stamped envelope to: Starz Big HD Sweepstakes, Dept. 6450, PO Box 5009, Stacy, MN 55078-5009, entries must be postmarked by August 24, 2009 and received by August 31, 2009.
There is a limit of one entry per person, regardless of the method of entry during the Sweepstakes Period. All entry information submitted becomes the property of Sponsor and will not be returned. Should multiple names be listed on a single subscription/account, the first name listed will be deemed the subscription/account holder. No robotic, programmed, script, macro or other automated entries, or third party entries, (collectively "automated entries"), all of which will be disqualified. Entries will be disqualified if they are incorrect, altered, delayed, deleted, destroyed, forged, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, late, lost, misdirected, non-delivered, stolen, tampered with, unauthorized or unintelligible. Entries will not be returned or acknowledged. By participating, entrants agree to be bound by these Official Rules and decisions of Sponsor, which are final and binding in all matters relating to this Sweepstakes.
PRIZES/ODDS: Grand Prize (1) Home Entertainment Makeover. Home Entertainment Makeover must include at minimum a new television and sound system (selected by Sponsor) and will include a consultation with a professional designer (selected by Sponsor) located near winner's residence. Structural changes or additions are not included in the Grand Prize package. All improvements will be aesthetic only. Grand Prize winner is responsible for obtaining all permits and inspections and consents necessary and is responsible for securing any insurance. Grand Prize winner will be responsible for costs exceeding $25,000 prize value should an estimate of services exceed the prize value and Grand Prize winner elects to move forward with services or purchases, or Grand Prize winner can adjust scope of project to fit within $25,000 Grand Prize retail value. Payment for difference in prize value may be required in advance. Releasees (as defined below) are not responsible for contractor liens. While the Grand Prize winner is not obligated to retain the changes made to the interior/exterior of the residence, Sponsor is not required to restore the residence to its original condition. The Grand Prize winner will be asked to provide written assurance of his/her willingness to accept the Home Entertainment Makeover, and to provide a waiver of any liability as a condition of winning this Sweepstakes, including release of any liability relating to any damages that may occur in connection with the Home Entertainment Makeover. If Grand Prize winner is not the exclusive owner of his/her residence, he/she will be responsible for obtaining permission from the applicable parties and may be asked and required to present proof of such permission in a form satisfactory to Sponsor. If Grand Prize winner is unwilling or unable to accept any portion of Grand Prize, Sponsor reserves the right to disqualify Grand Prize winner, and, at its discretion, select an alternate Grand Prize winner. Prizes and consultation may be subject to warranties, disclaimers and limitations set forth in any sales contract and/or standard warranty of merchandise. Approximate Retail Value of Grand Prize is $25,000. Sponsor will determine all elements of prizing in its sole discretion. Actual prize value will be determined by the size and needs of the home in which the Home Entertainment Makeover is conducted. Any difference between the stated value and the actual value will not be awarded. Costs and expenses not stated are the sole responsibility of the winner. Other restrictions may apply.
One hundred (100) First Place Prizes: One hundred First Place Prize winners will each receive a Starz Entertainment Gift Pack with an ARV of $25 each. The total ARV of all prizes is $27,500. Odds of winning depend on the number of eligible entries.
PRIZE DRAWING: Prize winners will be selected in a random drawing of all eligible entries on or about September 14, 2009. Sponsor will attempt to notify potential winner by mail, overnight mail and/or telephone approximately two days after that drawing. The drawing and awarding of prizes will be conducted by Promotion Management Center, an independent judging organization, whose decisions are final and binding in all matters relating to the Promotion. Potential winners may be required to complete, sign and return an Affidavit of Eligibility, Liability and (where permitted) Publicity Release within 10 days of notification, or prize may be forfeited. Any prize or prize notification returned as undeliverable or refused will result in entrant disqualification, and an alternate winner may be selected. If winner is a minor in his/her state of residence, the prize will be awarded to the minor's parent or legal guardian and the parent or legal guardian must complete, sign and return an Affidavit of Eligibility and Liability and (where permitted) Publicity Release within the same time period. By accepting a prize, winner consents to the use of his/her name, likeness, photograph, biographical information and statements by Sponsor in advertising, promotional materials and on its web sites without notice or compensation. Limit of one prize per household.
GENERAL RULES: By entering, each entrant and winner assumes all liability for any injury or damages caused or claimed to be caused by the Sweepstakes, his or her participation in the Sweepstakes and/or the acceptance, possession, use or misuse of any prize, and releases and holds harmless Starz Entertainment, LLC, and their respective parents, subsidiaries, affiliates and the officers, directors, employees, shareholders and agents (collectively, Releasees) of each from and against any and all damages, including, without limitation, negligence, claims, actions and/or liability in connection therewith including, without limitation, personal and bodily injury, death or disability, property damage or loss or damage of any other kind. Entries are void if defective, altered, forged or submitted via unauthorized channels, and Sponsor reserves the right to disqualify any individual using such method. Starz Entertainment, LLC, and their respective parent companies, subsidiaries, affiliates and their respective officers, directors, employees, shareholders and agents are not responsible for any: (a) telephone, computer or network malfunction, human or other error or failure to properly process entries; (b) communication disruption or other forces beyond their reasonable control, including inability to access any web site, submit entries or other disruption related to internet traffic, virus, bug or unauthorized intervention; (c) damage caused by computer virus or otherwise resulting to any computer from entrant's access to the Sweepstakes Web site or entry into the Sweepstakes; or (d) printing or other errors appearing in the rules or other Sweepstakes materials. If any circumstance occurs which impairs the administration, security, fairness, integrity or proper play of the Sweepstakes, Sponsor may, in its sole discretion, suspend or terminate the Sweepstakes by posting a notice on www.starz.com/bighdsweeps. If the Sweepstakes is terminated before the end date, Sponsor may select potential winner in a random drawing from all eligible entries received as of the termination date. Persons found tampering with or abusing any aspect of this Sweepstakes, or whom Sponsor believes to be impairing the administration, security, fairness, integrity or proper play of the Sweepstakes will be disqualified. Taxes on prizes, if any and any other costs not listed herein are the winner's responsibility. No substitutions or exchange for cash allowed, except at Sponsor's sole discretion. Prize is awarded "as is" with no warranty or guarantee, either express or implied.
LIMITATIONS OF LIABILITY: Releasees are not responsible for misdirected or non-delivered entries/e-mails; or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Web site or other connections availability, accessibility or traffic congestion, or miscommunications, or failed computer, network, telephone, satellite, or cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network, or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information. Releasees are not responsible for any incorrect or inaccurate information, whether caused by Web site users, or by any equipment or programming associated with or utilized in this Sweepstakes and assume no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of Web site. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or operation of the Sweepstakes or Web site, to be acting in violation of the terms of the Web site or to be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse or harass any other person. Releasees are not responsible for injury or damage to participants' or any other person's computer related to or resulting from participating in this Sweepstakes or downloading or copying materials from or use of Web site. If, for any reason, Sweepstakes is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, hacking, unauthorized intervention, fraud, technical failures or any other causes which, in sole opinion of the Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend Sweepstakes, and determine winner from entries received prior to action taken, or as otherwise deemed fair and equitable by Sponsor. Any attempt to deliberately damage any web site or undermine the legitimate operation of the Sweepstakes is unlawful and subject to legal action by Sponsor or its agents. In case of dispute regarding Internet entries, the authorized subscriber of email account used to enter the Sweepstakes, at actual time of entry, will be deemed to be participant and must comply with these Official Rules. Authorized account subscriber is deemed to be natural person who is assigned an email address by an Internet Access Provider, online service provider, or other organization that is responsible for assigning email addresses.
